BACKGROUND
FUSD's Board of Education unanimously adopted the current Trustee Plan Map at its December 8, 2021 regular meeting.

2021-22 MAP ADJUSTMENTS: 2020 CENSUS DATA IMPACT ON DISTRICT’S TRUSTEE AREA MAP

Based on 2020 Census data, school districts with trustee area systems are required to review and, if necessary, adjust their trustee area map by March 1, 2022 to ensure population balance. This applies to FUSD, which transitioned to a by-trustee area election system in the 2019-2020 school year to ensure compliance with the California Voting Rights Act or "CVRA" (see below: 2019 Transition to a New System of Electing Governing Board Members).

Please note that this is a required action when Census data is released every decade. This action does not impact school boundaries.

District Board Adopts Trustee Area Elections, Selects Map Plan 1

On December 10, 2019, the Governing Board formally adopted a resolution to transition to a by-trustee area election system and adopted Map Plan 1 (BoardDocs) as the District’s trustee area plan.  Prior to making its decision, the Governing Board held public meetings to review proposed maps and took comments from the community.  Next, the Governing Board will submit a petition to the Alameda County Committee on School District Organization for review and approval.

Sixth Map Option for Consideration - 

The District’s demographer has created an additional map, Plan 6, following public feedback provided at the District’s November 20, 2019 public hearing.  Plan 6 joins Plans 1-5 as options currently under consideration by the District’s Governing Board.  Plan 6 offers a different look compared to many of the other options while still attempting to keep many elementary school attendance areas intact.  Plan 6, like the other options, meets the equal population requirement and increases the voting power of the largest protected classes in the District (Hispanic/Latino; Asian; and African American) by Citizen Voting Age Population (CVAP/eligible voters) in at least two Trustee Areas per map based on up-to-date CVAP statistics compared to District-wide averages. Additionally, Plan 6 creates two Asian majority areas per map by CVAP.

Each map option for consideration:

  1. Meets the equal population requirement (that each trustee area have equal population with up to a 10% variance);
  2. Increases the voting power of the largest protected classes in the District (Hispanic/Latino; Asian; and African American) by Citizen Voting Age Population (CVAP/eligible voters) in at least two Trustee Areas per map based on up-to-date CVAP statistics compared to District-wide averages;
  3. Creates minimum of two Asian majority areas per map by CVAP;
  4. Complies with the Federal Voting Rights Act;
  5. Respects communities of interest as much as possible;
  6. Is compact and contiguous as much as possible; and
  7. Follows man-made and natural geographic features as much as possible.

Additional Map Option for Consideration and Updates - 

The District’s demographer has created an additional map, Plan 5, following public feedback provided at the District’s October 30, 2019 public hearing.  Plan 5 joins Plans 1-4 as options currently under consideration by the District’s Governing Board.  Plan 5 attempts to keep as many elementary school attendance boundaries intact as possible – though it is not possible to keep all elementary school boundaries intact and still maintain required population equality per Trustee Area.   Plan 5, like the other options, meets the equal population requirement and increases the voting power of the largest protected classes in the District (Hispanic/Latino; Asian; and African American) by Citizen Voting Age Population (CVAP/eligible voters) in at least two Trustee Areas per map based on up-to-date CVAP statistics compared to District-wide averages.  Additionally, Plan 5 creates three Asian majority areas per map by CVAP.  This Plan also keeps the Mission San Jose area together.

The District also received comments regarding attempting to calculate how many students presently live in each Trustee Area per map option.  Since attendance areas are often split amongst multiple Trustee Areas, it will be difficult to determine exactly how many students from each Trustee Area currently attend which schools.  Importantly, student attendance is not one of the legal criteria for consideration when preparing and selecting a map option for this transition.  The most important population information, and top criteria, is total population equality per Trustee Area (within a permissible 10% variance).  All Plans meet this requirement.

The District also received feedback regarding whether it was possible to further spread the American HS attendance area (in Trustee Area 1 on all Plans) amongst more Trustee Areas.  The northwestern corner of the District (the American HS attendance area) is densely populated and wraps around the northern portion of Newark.  There are approximately 52,000 people living within the American HS attendance boundary.  To achieve population equality, the District’s Trustee Areas need to contain approximately 42,800 people per area.  This, along with the requirement that each Area be geographically contiguous, makes it difficult to stretch Trustee Area 1 to reach outside of the American HS attendance area while still maintaining relative geographical compactness.

Four Map Options for Consideration - 

As the District continues to move through the process of transitioning to "by-Trustee-area" elections under the legal requirements of the California Voting Rights Act (CVRA), we have reached an important juncture. The District is releasing four map options to the community for study and input. All four of the map options being considered meet the legal requirements outlined in CVRA.

The District is providing three in-person opportunities to the community to review and provide feedback over the next seven weeks before the Board of Education votes on December 10, 2019 for a map that will be put into effect for the November 2020 Board elections.

This release of map options comes at the end of the "Pre-Map" period wherein the District engaged the community with two public hearings to solicit input before drawing map options.

Dear Parents and Community Members:

I am writing to encourage your participation in an important process led by the Fremont Unified School District Governing Board.

Starting on September 11, 2019, the District initiated the process of transitioning the method by which Governing Board members are elected.  Under the current “at-large” system, all registered voters in the District’s boundaries can vote for candidates for Board member seats.  Under the new proposed system, candidates will be elected by “trustee areas.”  This means only voters within a given trustee area can vote for candidates who reside within that same area.  The intent of this proposed system is to offer greater opportunities for Board representation for candidates that might not otherwise be elected under an at-large system.

Transitioning to this new system requires the Board to hold public hearings on proposed trustee area boundaries (or maps) prior to asking the Alameda County Committee on School District Organization to approve the change.  If the Committee approves the change, “by-trustee” area voting would be held starting with the 2020 general election, on Tuesday, November 3, 2020.

Before the District prepares and presents draft map options, the law requires the District to hold two public hearings to solicit comments and feedback regarding potential trustee areas.  Thereafter, the District will be hosting a series of public hearings regarding the map options, once created.  You are invited to attend as many as you would like.  If you cannot attend a hearing or meeting and wish to review and/or comment regarding potential trustee areas as well as on the proposed “trustee area” maps, once created, please do not hesitate to submit your comments ad feedback to the email address below.  Following the initial public hearings, the proposed maps will be created and posted on this web site.
